BURGLAR JAILED 18 YEARS FOR KILLING PENSIONER IN HACKNEY RAID
A burglar has been jailed for 18 years, with a further five years on extended licence, after headbutting and killing an elderly man who tried to protect his wife during a break-in at their Hackney home. Ashley Malcolm, 40, attacked 86-year-old John Burke at the property he shared with his 91-year-old wife, Peggy, in the early hours of 29 September 2025. Sentencing him at the Old Bailey, Judge Simon Mayo KC said Malcolm embarked on a sustained course of criminal conduct overnight, breaking into several residential properties and entering the home of the two elderly occupants over a prolonged period. The judge said Malcolm headbutted Mr Burke during the burglary, fracturing his nose and causing intercranial bleeding, from which he died. Malcolm pleaded guilty to manslaughter and a string of other offences.
Judge Mayo told the court that Mr Burke's family, including his widow of many decades, had suffered an "immeasurable" loss. Court records show that within hours of the fatal burglary, Malcolm broke into a care home and attempted to burgle another flat while its occupants were present. A number of Mr Burke's relatives attended the sentencing, with his two sons and a grandson reading victim impact statements. Sean Burke, who found his father collapsed and unresponsive at home the day after the attack, told the court his father was a quiet, hard-working man who never had a bad word for anyone and had earned the right to die of natural causes.
The sentencing was televised from the Old Bailey on Thursday. Judge Mayo set out the chain of events leading to Mr Burke's death as part of his remarks on Malcolm's wider offending that night. Malcolm's 18-year prison term is to be followed by five years on extended licence once he is released. The case was heard alongside the other burglary and attempted burglary offences to which Malcolm admitted guilt.
