TWO MEN JAILED UNDER NEW CHANNEL CROSSING ENDANGERMENT LAW

Mohammad Tajik, an Afghan national, and Alnour Ali, a Sudanese national, have become the first people sentenced under a new offence of endangering others during a Channel crossing. Both men had piloted small boats and appeared at Canterbury Crown Court on Wednesday. Tajik received a two-year sentence, while Ali was sentenced to 27 months. The new offence of endangering others during a sea journey to the United Kingdom came into force in January as part of new border security legislation.

Judge Simon James, presiding at Canterbury Crown Court, stated that the dangers of navigating one of the busiest shipping lanes in the world in vessels not designed for such crossings were obvious. He noted that the risk of death and serious injury increases significantly when boats carry no navigational aids, are overcrowded, and passengers lack adequate safety equipment. The sentencing marks the first time the January legislation has resulted in a custodial outcome. Both sentences exceed the two-year minimum threshold associated with the offence.

The cases establish a legal precedent for prosecutions brought under the border security legislation introduced earlier this year. The new offence specifically targets those who pilot or operate vessels in ways that endanger other people during Channel crossings. Canterbury Crown Court's handling of both cases confirms that the legislation is now being actively applied by prosecutors. Further prosecutions under the same law remain possible as the offence continues to be enforced.
