PROSECUTORS OPPOSE PAROLE FOR ERIN PATTERSON IN MUSHROOM MURDERS CASE

THU 20 AUG 2026 CRIME

Prosecutors have urged Victoria's Court of Appeal to deny parole for Erin Patterson, arguing she should remain imprisoned for life. Patterson was sentenced to life imprisonment with a minimum 33-year non-parole period after being convicted of murdering three relatives with toxic death-cap mushrooms served in a Beef Wellington meal in July 2023. Victoria's top prosecutor Brendan Kissane KC described the 33-year minimum sentence as manifestly inadequate given the nature of Patterson's conduct. Patterson is currently appealing her conviction on three counts of murder and one count of attempted murder, claiming the poisonings were accidental.

Crown prosecutors have rejected defence claims that the convictions constitute a miscarriage of justice. Prosecutors stated there was no evidence Patterson had a legitimate interest in foraging for wild mushrooms. They dismissed Patterson's account of events as lacking substance, according to their submissions to the court.

The appeal process will determine whether Patterson's convictions stand and whether the original sentencing will be reviewed. The Court of Appeal will assess the arguments presented by both prosecutors and the defence regarding the adequacy of the sentence and the validity of the convictions. The case continues to proceed through Victoria's appeal system.
