BURNHAM BARS RAPE AND GROOMING OFFENDERS FROM EARLY RELEASE SCHEME

Prime Minister Andy Burnham announced on 3 August that rape, serious child sex offences and grooming will be excluded from a sentencing scheme designed to ease prison overcrowding. The decision follows Burnham's pause of the early release programme in his first week in office and an urgent review he ordered to assess public safety risks. The scheme, originally scheduled to begin in September, will now be delayed until October. Under the original plan, approximately 6,000 prisoners were due for early release.

The early release scheme was introduced by the Labour government to address a crisis-hit prison system inherited from the previous Conservative administration. Adult male prisons currently operate at 98 per cent capacity, according to official figures. Burnham stated he wanted to exclude more offender categories from the scheme but said doing so would risk the prison system collapsing entirely, which he argued would pose greater public safety risks. The scheme was designed to ease overcrowding after concerns that jails could run out of spaces completely.

Burnham said he had listened to victims' concerns in making the changes. He acknowledged public anger and distress caused by the original scheme, stating: "Keeping the public safe is my top priority." In place of broader sentence reductions, the government will introduce tougher community supervision measures, including a presumption that all released offenders will be tagged with GPS monitoring, longer supervision periods and restriction zones. Burnham attributed the prison capacity crisis to underinvestment in the prison estate over the previous decade.
