HP INDIA FINED 1.42 BILLION RUPEES FOR GOVERNMENT TENDER MANIPULATION

India's Competition Commission has fined HP India 1.42 billion rupees (approximately $14.7 million) across two separate cases involving the manipulation of government procurement tenders between 2017 and 2020. The regulator accused HP India and associated resellers of coordinating bids for contracts on the Government e-Marketplace by agreeing bid prices in advance, submitting deliberately uncompetitive offers to simulate competition, and controlling discount levels. The CCI's investigation uncovered one case relating to personal computers and a separate case relating to printing consumables including ink and toner.

In the printing consumables case, the CCI identified evidence including emails, witness statements, WhatsApp group conversations and a 2019 video from a reseller meeting that documented discussions about which companies would submit supporting bids, agreed pricing, discounts and which reseller would win particular contracts. The regulator determined that 16 Tier-2 resellers had violated competition law through bid rigging, resulting in fines of 119.8 million rupees for HP India and 23 million rupees combined for its resellers. A second case revealed similar conduct across laptops, desktops, workstations, point-of-sale systems and peripherals, with five additional resellers involved and total fines of 1.3 billion rupees for HP India and 12.2 million rupees for its partners.

The fine amount reflected a reduction granted because HP India self-reported its conduct and submitted an application for a reduced penalty. Without that disclosure, the company would have faced substantially higher financial sanctions according to the CCI's final orders.
