The alleged victim, Kristen Stubbs, failed to attend two scheduled appointments to provide a sworn statement to police. Her legal representative subsequently informed officers that she would not be furnishing a statement. Police stated in their report that without independent corroboration, they could not identify who initiated the physical altercation or establish facts that would support prosecution beyond reasonable doubt.
The police report concluded that no further investigative steps could reasonably be undertaken with the information then available. The closure of the inquiry occurred without filing formal charges against Smith.
